另，二方协议并未排除用人单位风险，当协议任何一方违约时，违约条款均生效。比如去年校招某些公司大批量违约校招生，于是就每个人赔了几千块，至于工作嘛，自己找（笑。

建议讨论之前明确一下适用法律。**二方**协议不是三方，一般是在三方还没出具之前公司和你签订的协议。注意，这是一份协议，并没有规定你和公司的劳动关系，不是劳动合同，而是用以约束双方的义务和权利（指在规定期限内确立就业关系的权利及义务）的，所以并不适用于劳动合同法，而适用民法典合同篇（即原合同法）。
根据民法典第五百八十五条“当事人可以约定一方违约时应当根据违约情况向对方支付一定数额的违约金，也可以约定因违约产生的损失赔偿额的计算方法。”，因此就业协议书或二方协议中违约金是符合法律规定的。
在校招过程中，毕业生违约是很常见的。建议 lz 可以考虑从几个方面去了解，比如过往毕业的学长学姐中是否有类似的经历，并考虑和 hr 商量一下违约的事情，看能否放弃追讨违约金。
